Recruitment, Employment and the Trade Practices Act (Deceptive and Misleading Conduct)

Sunday, September 6th, 2009

Most employers do not realise that advertising, recruitment and employment of employees is covered by the Trade Practice Act.

Deceptive and misleading conduct regarding advertising, recruitment and employment has seen more than a few employers run aground and taken to court over this conduct. Your advertisements, recruitment and employment as advertised and offered must be what the employee experiences.

Statements for example as ‘needs some initial cleanup work’ may find you accused of deceptive and misleading conduct in that the employee finds themselves in a situation where they are under stress and pressure fixing up complete messes.

We have considerable experience and expertise to assist you with your advertising, recruitment and pre-employment documents, checklists, guidelines and sound consultation and mentoring.

457 workers – important employer obligations

Sunday, September 6th, 2009

A subclass 457 visa is a long stay temporary business visa and is a program designed for employers to sponsor overseas workers to work in Australia on a temporary visa.

The government has strengthened compliance for subclass 457 workers visas and there are specific obligations you have towards overseas workers.

These include:
• Complying with visa requirements;
• Paying award and meeting minimum employment conditions;
• If you decide to retrench a 457 visa worker meet the specific guidelines and obligations that you must comply with.

As these can be complex and difficult matters it is prudent to take advice and we can assist you with these matters. Biz Momentum proactively works at protecting your business and you with peace of mind.
