Modern Awards 1 January 2010
The 10 National Employment Standards come into force 1 January 2010 for all employees regardless of whether the employee is considered an award worker or a high income earner by the Fair Work Act.
A high income earner is one who earns more than $108,300 (indexed each year) and is not subject to an award.
These are the minimum entitlements to all employees in Australia covered by Fair Work.
The 10 NES are:
1. Hours of work
2. Flexible work for parents
3. Parental leave
4. Annual leave
5. Personal/carers and compassionate leave
6. Community service leave
7. Long-service leave
8. Public Holidays
9. Notice of termination and redundancy pay
10. Fair Work Information Standard
The base loading for all causal employees has been increased to 25% across the board.
There are phasing in and transitional provisions which is award specific.
The rules for transmission of business have changed and you must be aware of your obligations if you buy or sell a business.
Jury service is now considered community service leave and make up to the employee is to be made by the employer.
