Are your Employment Agreements up to date?

The introduction of Fair Work has brought about many changes that an employer is required to keep abreast of and ensure compliance with.

Most employment agreements are now out of date and now may be a good time to bring your agreements up to date.
There are significant penalties for non compliance.

Parental leave and Foster Parents

Unfortunately the National Employment Standards and Fair Work do not allow for unpaid foster parent leave such as would apply for normal parental leave entitlements and arrangements.

Employers can allow their employees’ to take leave without pay however they are not obliged or required to do so.

Annualised Salaries Agreements

The implementation of Modern Awards has opened up the possibilities of employers entering into Annualised Awards with their employees.

This provides that an employer may pay an employee an annual salary in satisfaction of certain provisions of the award such as;

1.       Minimum weekly wages;
2.       Allowances;
3.       Overtime and penalty rates; and
4.       Annual leave loading.

Where an annual salary is paid the employer must advise the employee in writing of the annual salary that is payable and which of the provisions of this award will be satisfied by payment of the annual salary. The annual salary must not disadvantage the employee and must be reviewed annually.

Cashing out annual leave – Accountants and Professionals

An employer and an award/agreement-free employee (such as an Accountant, Human Resource Professional and Lawyers to name a few employees in award free categories) can agree to the employee cashing out a particular amount of the employee’s accrued annual leave.

Modern Awards 1 January 2010

The 10 National Employment Standards come into force 1 January 2010 for all employees regardless of whether the employee is considered an award worker or a high income earner by the Fair Work Act.

A high income earner is one who earns more than $108,300 (indexed each year) and is not subject to an award.

These are the minimum entitlements to all employees in Australia covered by Fair Work.
