A business was fined $60,000 recently for terminating the employment of 3 people because they were union members.

Your 2010 New Years Business Resolutions

Fair Work is here with all its changes and modern awards. Some practical goals for your business 2010 ‘New Year’s’ resolutions maybe;

1.   Review and update your employment agreements for the new changes to be legally compliant;

 

2.   Review your policies and procedures; are they compliant with your employment obligations;

 

3.   Re-induct your employees to remind them of their obligations and remember that if you cannot prove your employees were regularly updated you will be held responsible in the event of a workplace incident.

Modern Awards 1 January 2010

The 10 National Employment Standards come into force 1 January 2010 for all employees regardless of whether the employee is considered an award worker or a high income earner by the Fair Work Act.

A high income earner is one who earns more than $108,300 (indexed each year) and is not subject to an award.

These are the minimum entitlements to all employees in Australia covered by Fair Work.

Work Health and Safety Bill – cooperative federalism

Work Health & Safety has been traditionally managed by individual states in Australia. However in recent times states have been convening and discussing a work health and safety bill to cover all jurisdictions.

The Bill was rubber stamped recently and is scheduled to start on 1 January 2012.

The upshot is that whether you work in Qld, NSW or WA you will be uniformly covered by the same legislation in those states.

Serious and Terminal Illness in the Workplace

Death and serious illness is not a favoured topic in the workplace. We as a society have built a taboo around such subjects so that we are insular and isolated from these matters.  However, the honest fact is that in the employment environment, if you employ workers, you will be faced at some time with serious and terminal illnesses in the workplace: an employee’s or yours.  Serious illness is not a respecter of person’s and usually visits when least convenient to you and your business however you must face the issue head on.  You may have questions such as how long will the employee be away, do I need to keep their employment open, how should my employees and I react to the person along with many others. You should not be surprised if you experience many mixed emotions or fail to understand how to deal with these matters. This is understandable!  The there is a variety of legislation you must consider before making decisions when facing such issues and your business has a number of obligations towards employees. The fact is that this is not an easy time for you as a business owner however the truth is the employee needs your support.
