Cashing out Annual Leave

The Fair Work Act allows the cashing out of annual leave by agreement. The provisions are subject to certain restrictions that include a requirement that an employee retains at least four weeks annual leave after the cash out.

A modern award may also make provision for cashing out annual leave. This provision may apply to award and award free employees.

The AIRC has decided to include Accountants in a Miscellaneous Award and recently released draft details. Accountants have been traditionally award free however now a raft of obligations that they must comply with.

What is an Individual Flexibility Agreement

An Individual Flexibility Agreement is a useful mechanism for employers who have Award or Enterprise Agreement covered employees.

Flexibility provisions within Modern Awards allow employers and an individual employee to enter into arrangements whereby certain terms of the Award are modified to meet the individual circumstances of the employment relationship.

Flexibility provisions in Awards specify a number of terms of the Award which may be altered by a Flexibility Agreement (for example, Hours of Work, Overtime, Penalty Rates etc.). It is only those terms that are stated in the flexibility provisions of the Award that may be altered by arrangement.

Parental Leave (Maternity, Paternity and Adoption)

On 1 January 2010 the National Employment Standards include the provision for both partners to apply for 12 months leave.
The standard also allows that after the 12 months of parental leave one partner can apply for a further period of leave of up to 12 months equalling 24 months in total.

This means that those employees you have on leave before January 2010 will be able to take advantage of this provision. You need to ensure that your policies and procedures are up to date and that employees are informed.
